1. Introduction

Time To Show Up wishes to be transparent with all our policies and terms. We have kept these as simple and brief as possible to cover the necessary.

2. Data collected

DATA STORAGE LOCATION

Time To Show Up is UK based entity and is governed by English law. However the hosting for our website and newsletter is Squarespace, which is based in the United States and it users are subject to their Privacy Policy and Terms of Service.

REGISTRATION DATA

Should you register for our newsletter, your email address and name will be processed by SquareSpace which hosts our newsletter service. You can unsubscribe at any time by clicking on the link at the bottom of each newsletter. We will not use your contact information for anything other than communicating with you about the Time To Show Up podcast, video series, community, or other business directly related to Time To Show Up. We understand that people are over-run by such newsletters and we will keep ours to a respectable minimum.

Should you wish to join as a subscriber to the Time To Show Up community, our community platform is run by Circle which is also located in the United States. By joining as a member you will be accepting their Privacy Policy and Terms of Service. Subscription payments are relayed via Stripe covered by it’s Privacy Policy.

Time To Show Up collects only the minimum amount of information we need from you in order to run our community and services. You may cancel your membership at anytime and ask to have any information we have collected to be deleted.

PERSONAL DATA

We use your personal information in the following cases:

  • Verification/identification of the user during website usage;

  • Providing technical assistance;

  • Sending updates to our users with important information to inform about news/changes;

  • Checking the accounts’ activity in order to prevent fraudulent transactions and ensure the security of our customers’ personal information;

  • Customise the website to make your experience more personal and engaging;

  • Receive one-time or recurring payments from our users;

  • Guarantee overall performance and administrative functions run smoothly.

CONTACT FORM

Information submitted through the contact form on our website site is sent to our company email. Anything we receive is used for customer service purposes only and are never used for marketing purposes or shared with third parties.

ANALYTICS

We may use Google Analytics or similar tracking software on our site for anonymous reporting of site usage. No personalised data is stored. If you would like to opt-out of Google Analytics monitoring your behaviour on our website please use this link: Google Analytics Opt-out.

Community Terms of Use

1. BINDING EFFECT. This is a binding agreement. By using the Internet site located at https://www.timetoshowup.org (the “Site” or “Service”) or any services provided in connection with the Site, you agree to abide by these Terms of Use, as they may be amended by Time To Show Up (TTSU) from time to time. TTSU will post a notice on the Site any time these Terms of Use have been changed or otherwise updated.

2. PRIVACY POLICY. TTSU respects your privacy and permits you to control the treatment of your personal information. A complete statement of TTSU’s current privacy policy can be found via this link. TTSU’s privacy policy is expressly incorporated into this Agreement by this reference.

3. GOVERNING LAW. These Terms shall be construed in accordance with English law. You hereby irrevocably consent to the exclusive jurisdiction of English courts in all disputes arising out of or related to the use of the site.

4. AGE. The site is intended only for users aged 18 or older. Individuals under the age of 18 are strictly prohibited from using the site and the accounts for any such person shall be terminated upon discovery.

5. USER CONTENT. You grant TTSU a license to use the materials you post to the Site or Service. By posting, downloading, displaying, performing, transmitting, or otherwise distributing information or other content (“User Content”) to the Site or Service, you are granting TTSU, its affiliates, officers, directors, employees, consultants, agents, and representatives a license to use User Content in connection with the operation of the Internet business of TTSU. By posting User Content on the Site or Service, you warrant and represent that you own the rights to the User Content or are otherwise authorized to post, distribute, display, perform, transmit, or otherwise distribute User Content. Please familiarise yourself with Circle’s terms with regard to what you post on the community platform.

7. COMPLIANCE WITH INTELLECTUAL PROPERTY LAWS. When accessing the Site or using the Service, you agree to obey the law and to respect the intellectual property rights of others. Your use of the Service and the Site is at all times governed by and subject to laws regarding copyright ownership and use of intellectual property. You agree not to upload, download, display, perform, transmit, or otherwise distribute any information or content (collectively, “Content”) in violation of any third party’s copyrights, trademarks, or other intellectual property or proprietary rights. TTSU reserves the right to terminate your receipt, transmission, or other distribution of any such material using the Service, and, if applicable, to delete any such material from its servers. Company intends to cooperate fully with any law enforcement officials or agencies in the investigation of any violation of these Terms of Use or of any applicable

9. ALLEGED VIOLATIONS. TTSU reserves the right to terminate your use of the Service and/or the Site. To ensure that TTSU provides a high quality experience for you and for other users of the Site and the Service, you agree that TTSU or its representatives may access your account and records on a case-by-case basis to investigate complaints or allegations of abuse, infringement of third party rights, or other unauthorised uses of the Site or the Service. TTSU does not intend to disclose the existence or occurrence of such an investigation unless required by law, but TTSU reserves the right to terminate your account or your access to the Site immediately, with or without notice to you, and without liability to you, if TTSU believes that you have violated any of the Terms of Use, furnished TTSU with false or misleading information, or interfered with use of the Site or the Service by others.

10. NO WARRANTIES. TTSU HEREBY DISCLAIMS ALL WARRANTIES. COMPANY IS MAKING THE SITE AVAILABLE “AS IS” WITHOUT WARRANTY OF ANY KIND. YOU ASSUME THE RISK OF ANY AND ALL DAMAGE OR LOSS FROM USE OF, OR INABILITY TO USE, THE SITE OR THE SERVICE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, TTSU EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SITE, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT. 12. LIMITED LIABILITY. COMPANY’S LIABILITY TO YOU IS LIMITED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TTSU BE LIABLE FOR DAMAGES OF ANY KIND (INCLUDING, BUT NOT LIMITED TO, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, LOST PROFITS, OR LOST DATA, REGARDLESS OF THE FORESEEABILITY OF THOSE DAMAGES) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR ANY OTHER MATERIALS OR SERVICES PROVIDED TO YOU BY COMPANY. This limitation shall apply regardless of whether the damages arise out of breach of contract, tort, or any other legal theory or form of action.

TTSU works with a number of partners and affiliates whose Internet sites may be linked with the Site. Because neither TTSU nor the Site has control over the content and performance of these partner and affiliate sites, TTSU makes no guarantees about the accuracy, currency, content, or quality of the information provided by such sites, and TTSU assumes no responsibility for unintended, objectionable, inaccurate, misleading, or unlawful content that may reside on those sites. Similarly, from time to time in connection with your use of the Site, you may have access to content items (including, but not limited to, websites) that are owned by third parties. You acknowledge and agree that TTSU makes no guarantees about, and assumes no responsibility for, the accuracy, currency, content, or quality of this third party content, and that, unless expressly provided otherwise, these Terms of Use shall govern your use of any and all third party content.

14. PROHIBITED USES. TTSU imposes certain restrictions on your permissible use of the Site and the Service. You agree to indemnify, defend, and hold harmless TTSU, its affiliates, officers, directors, employees, consultants, agents, and representatives from any and all third party claims, losses, liability, damages, and/or costs (including reasonable attorney fees and costs) arising from your access to or use of the Site, your violation of these Terms of Use, or your infringement, or infringement by any other user of your account, of any intellectual property or other right of any person or entity. TTSU will notify you promptly of any such claim, loss, liability, or demand, and will provide you with reasonable assistance, at your expense, in defending any such claim, loss, liability, damage, or cost.

16. SEVERABILITY; WAIVER. If, for whatever reason, a court of competent jurisdiction finds any term or condition in these Terms of Use to be unenforceable, all other terms and conditions will remain unaffected and in full force and effect. No waiver of any breach of any provision of these Terms of Use shall constitute a waiver of any prior, concurrent, or subsequent breach of the same or any other provisions hereof, and no waiver shall be effective unless made in writing and signed by an authorized representative of the waiving party.

18. NO LICENSE. Nothing contained on the Site should be understood as granting you a license to use any of the trademarks, service marks, or logos owned by Company or by any third party.

19. MODIFICATIONS AND INTERRUPTIONS We reserve the right to change, modify, or remove the contents of the Services at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on our Services. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Services. We cannot guarantee the Services will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Services, resulting in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the Services at any time or for any reason without notice to you. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the Services during any downtime or discontinuance of the Services. All information on the Site and our mobile application is provided in good faith, however we make no representation or warranty of any kind, express or implied, regarding the accuracy, adequacy, validity, reliability, availablity, or completeness of any information on the Site or our mobile application. UNDER NO CIRCUMSTANCES SHALL WE HAVE ANY LIABILITY TO YOU FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THIS SITE OR OUR MOBILE APPLICATION OR RELIANCE ON ANY INFORMATION PROVIDED ON THE SITE AND OUR MOBILE APPLICATION. YOUR USE OF THE SITE AND OUR MOBILE APPLICATION AND YOUR RELIANCE ON ANY INFORMATION ON THE SITE AND OUR MOBILE APPLICATION IS SOLELY AT YOUR OWN RISK.

21**. AMENDMENTS. TTSU reserves the right to amend these Terms. Should TTSU seek to make such an amendment and we, in our sole discretion, consider the amendment to be material in nature, we shall:**

(a) Clearly publish via our newsletter and/or community the fact an amendment is being made. You may contact us to discuss and contact information so you may discuss the proposed changes with us.

Should a court of competent jurisdiction rule this Amendment provision invalid, then this Amendment clause shall be terminated as part of this agreement with the agreement between us reverting to the previous set of terms applicable to the website. All amendments to the Terms shall be forward looking.

Cancellation of Membership

Learn and Grow subscriptions may be terminated at anytime by going to your membership page and cancelling. Membership will continue until the next billing period. Please make note of your billing date as once a payment has been made it is no longer refundable.

Lead Memberships are individual memberships and quality is constantly evaluated within the programme. If you are unsatisfied at any point please let us know so we can take the opportunity to resolve the issue with you. Should we be unable to resolve the issue we may make a full or proportional refund depending on the degree of service used at the point of withdrawal.
